Terms of Service

These Terms of Service govern your access to and use of apps, websites, and related services built and operated by Joseph D. Smith. By using a service, you agree to these terms and the applicable Privacy Policy.

If you do not agree, do not use the service.

You must be legally able to enter into this agreement. A parent or legal guardian must approve use by anyone who has not reached the age of majority in their location.

You may use the services for lawful personal or business purposes. You are responsible for your activity, your accounts, and the systems or content you access through a service.

You must not misuse a service, disrupt its operation, bypass access controls, infringe intellectual property rights, access systems without authorization, distribute malicious code, or use a service to violate applicable law.

You are responsible for safeguarding credentials, devices, access tokens, and authentication methods used with a service. Notify us promptly if you discover unauthorized access or a security issue involving a service.

Paid features, subscription periods, prices, and trial eligibility are shown before purchase. Purchases made through an app marketplace are billed and managed by that marketplace under its payment terms.

Auto-renewing subscriptions renew unless canceled through the marketplace account settings before the renewal date. Deleting an app does not cancel a subscription. Trials convert to paid subscriptions unless canceled before the trial ends.

Refund requests are handled by the marketplace that processed the purchase, except where applicable law requires otherwise.

A service may connect to third-party products, networks, websites, or accounts. Those services have their own terms and privacy practices. We do not control their availability, security, or content.

The services, branding, software, and original content are owned by Joseph D. Smith or their licensors. These terms grant a limited, revocable, non-exclusive, non-transferable right to use the services as provided.

You retain ownership of content and credentials you provide. You grant only the rights needed to process that material for the requested service.

We may update, suspend, or discontinue features to maintain security, comply with law, or improve a service. We may terminate access for a material violation of these terms.

Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

You are responsible for backups and for reviewing commands or actions before they affect your data, devices, accounts, or remote systems.

To the maximum extent permitted by law, Joseph D. Smith will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from a service.

Our aggregate liability for a claim will not exceed the amount you paid for the applicable service during the twelve months before the event giving rise to the claim. Rights that cannot be limited under applicable law remain unaffected.

We may update these terms. The current version and effective date will remain available on this page. Continued use after an update constitutes acceptance of the revised terms.
